ALDI shopper says she was struck by forklift

SCRANTON — A business invitee is suing ALDI Inc., a discount supermarket, citing alleged negligence.

Judith Fox filed a complaint on Dec. 18 in the U.S. District Court for the Middle District of Pennsylvania against ALDI Inc., alleging the discount supermarket owner failed to keep its premises reasonably safe for its shoppers.

According to the complaint, the plaintiff alleges that on June 5, 2018, she was shopping at the ALDI store in Stroudsburg when she was struck by a moving forklift, causing her to fall. She sustained serious injuries and incurred damages, she says. The plaintiff holds ALDI Inc. responsible because the defendant allegedly failed to adequately screen employees to determine if they are fit and capable in operating a forklift.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $75,000, plus interest, costs and such other just and necessary relief. She is represented by Salvatore P.J. Vito of Strousburg.
