Century Support Services is accused in class action suit of sending unsolicited text messages

PITTSBURGH — Consumers have filed a class action lawsuit against Century Support Services LLC and Century DS LLC, citing alleged violation of the Telephone Consumer Protection Act (TCPA).

Terry D. Fabricant filed a complaint individually and as the representative of a class of similarly situated persons on Jan. 18 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging they violated TCPA by sending unsolicited text messages.

According to the complaint, Fabricant and other similarly situated individuals who have received unsolicited prerecorded calls and text messages from the defendants promoting its debt relief and counseling services have suffered the nuisance, waste of time, and aggravation from unauthorized advertisements, and have been subjected to an intrusion upon seclusion and invasion of their privacy. 

The plaintiffs hold Century Support Services LLC and Century DS LLC responsible because the defendants allegedly failed to honor the Do Not Call registry; unlawfully utilized an equipment that send text messages simultaneously and without human intervention; and sent automated text messages to the cellular telephone number of plaintiffs without their consent.

The plaintiffs request a trial by jury and seek judgment against defendants, certification of class action, award of actual and statutory damages, injunctive relief, plus interest, attorneys' fees, court costs, and other relief as the court deems just. They are represented by Clayton Morrow of Morrow & Artim PC in Pittsburgh and Ryan Kelly of Anderson + Wanca in Rolling Meadows, Illinois.
