Southeast Delco School District agrees to $45K settlement with boy allegedly assaulted by school bus aide

MEDIA – A 14-year-old boy who alleged he was assaulted by a school bus aide has filed a petition to settle his lawsuit against a school district. 

According to the Court of Common Pleas Delaware County filing, Devanti Beander, a minor and through his parent, Zakiya Beander filed a petition for leave to settle or compromise minor's action in their case against defendant Southeast Delco School District. 

Devanti Beander claims that in November of 2018 while riding on a school bus, he was assaulted by Justin-Iverson Fairfax, a school bus aide. According to the plaintiffs' petition, Devanti Beander suffered facial injuries and "emotional anguish" that caused him to require months of therapy. 

"Tortfeasor has tendered an offer of $45,000," the petition states. "Counsel is of the opinion that the proposed settlement is reasonable because it adequately addresses the liability of the defendant and compensates petitioner for the damages incurred."

According to the petition, the plaintiffs' attorney's fees amount to $14,985, which is 33 percent of the net settlement. The plaintiffs will receive $28,795.29 of the settlement. 

The plaintiffs are represented by William Davis of McMonagle, Perri, McHugh, Mischak & Davis PC in Philadelphia.
