PITTSBURGH — A fired employee is suing a North Carolina company, alleging his termination, it was due to his age.

Ronald Shemala filed a lawsuit Jan. 19 in the U.S. District Court for the Western District of Pennsylvania against Ply Gem Industries Inc., of Cary, North Carolina, alleging age discrimination and wrongful termination.

According to the complaint, Shemala was employed by the defendant as a territory sales representative before he was fired, by phone, on July 15, while he was on a sales trip. The suit states the defendant's reason for terminating Shemela was his sales performance, even though Shemala's sales were 6 percent over his goal at the time of his termination.

The lawsuit says Ply Gem subjected the plaintiff to aged-biased remarks on multiple occasions, and Shemala was replaced by a younger and less experienced employee.

Shemela seeks damages for all lost wages, bonuses and legal fees, as well as poor treatment. He also seeks a jury trial. He is represented by attorney Joel S. Sansone and Massimo A. Terzigni of the Law Offices of Joel Sansone in Pittsburgh.
