PITTSBURGH — Two employees of Rush Wellsite Services have filed a class-action lawsuit against the company for allegations of failing to pay proper overtime compensation.

Toby Vollmer and Ryan Janke, on behalf of themselves and all others similarly situated, filed a lawsuit on April 28 in the U.S. District Court for there Western District of Pennsylvania against Rush Wellsite Services LLC and Rush Wellsite Holding LLC, citing violations of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, Vollmer worked for the defendants as an operator in or out of their Canonsburg, Pennsylvania locations. Janke worked at the same location as a junior field engineer. The plaintiffs claims that they performed technical and manual labor and regularly worked in excess of 40 hours per week.

They aver that instead of paying them overtime compensation, the defendants paid their workers under a hybrid base salary plus job bonus system. In doing so, the defendants allegedly deprived workers of lawful overtime wages for the plaintiffs and all other class members.

Vollmer and Janke seek class action designation, liquidated damages equal to the amount of unpaid compensation, litigation expenses, and pre and post-judgment interest. They are represented by Joshua P. Geist of Goodrich & Geist PC in Pittsburgh; L. Derek Braziel and Jay Forester of Lee & Braziel LLP in Dallas; and Jack Siegel of the Siegel Law Group PLLC in Dallas.
