Nelson and Vern Grenade on July 18: 'Petition To Open/Strike Judgment E-filed Petition For Relief From A Judgment Of Non Pros'.
HARRISBURG – The Superior Court on March 1 upheld a trial court order granting summary judgment in a case in which the plaintiffs routinely missed court-set procedural deadlines, resulting in the court’s decision not to recognize an expert report that may have proved their case.
The Pennsylvania Superior Court has retroactively applied a ruling banning medical malpractice defendants from relying on an “error in judgment” defense at trial.
