Man's estate cites UPS in tractor-trailer crash

The estate of a man seriously injured in a crash with a U.S. Postal Service tractor-trailer has sued the agency and the driver.

Brenda Simmons of Newark, Delaware, as administrator for the estate of Leroy Simmons, filed a lawsuit April 3 in U.S. District Court for the Eastern District of Pennsylvania, against the U.S. Postal Service and Donald Franklin, a mail carrier.

According to the complaint, on May 25, 2013, Franklin rear-ended Leroy Simmons' 2010 Dodge Avenger at Lindbergh Boulevard and Island Avenue, Philadelphia, with a USPS tractor-trailer, causing Simmons "serious, painful and permanent personal injuries and damages." Leroy Simmons died Nov. 28, 2014.

Brenda Simmons seeks $300,000 in damages, plus costs. She is represented by attorney Louis B. Himmelstein of Philadelphia.
