Pathmark Stores Inc. named in slip-and-fall suit

A Philadelphia resident is suing supermarket chain Pathmark Stores Inc. for injuries she allegedly sustained after falling over clutter at one of the company’s grocery stores.

Chester, Pa.-based attorney Joseph Oxman, of the firm Oxman Goodstadt Kuritz P.C., filed the premises liability suit May 17 at the Philadelphia Court of Common Pleas on behalf of Ife Nii-Owoo.

According to the complaint, Nii-Owoo was shopping at the Pathmark at 4160 Monument Road in Philadelphia in early August 2009, when she tripped and fell over debris on the store’s floor.

The fall caused the plaintiff to sustain bruises, contusions of the body, aggravation of pre-existing degenerative spine conditions, lumbar spine strain and sprain, disc herniation, a shock to her nervous system and other physical injuries, the suit alleges.

As a result of her injuries, the plaintiff has incurred various medical, rehabilitative and drug expenses, and has experienced financial loss at the same time, the suit states.

The plaintiff has also suffered a loss of earning capacity due to her injuries, the complaint says.

Nii-Owoo is seeking a judgment against the defendant in an amount not in excess of $50,000.

The non-jury matter is set for an arbitration hearing on Jan. 19, 2012.
