Missouri man files individual denture adhesive cream mass tort

A St. Louis, Mo. man has filed an individual claim in the Denture Adhesive Cream Mass Tort Program at the Philadelphia Court of Common Pleas, alleging he sustained injuries after using the oral product.

Calvin Taylor, who says he used SuperPoligrip from about 2004 to the present, alleges that his use of the product caused him to sustain numerous physical injuries, including neuropathy, myelopathy, hyperzincuria, zinc toxicity, extensive nerve damage, hypocupremia, numbness, severe pain, tingling, tremors, cramps, muscle twitches, paralysis, inability to walk, loss of balance, loss of use of his upper and/or lower extremities, difficulty breathing, kidney and liver failure, bone marrow depletion, abdominal pain, nausea, vomiting, anemia, lethargy and other neurological disorders, as well as substantial pain and suffering, according to the lawsuit.

In addition to his bodily injuries, Taylor also claims that he suffered, and continues to suffer from, emotional injuries including distress, depression, anxiety, worry and anguish.

Additionally, the plaintiff alleges that he has incurred significant economic damages, since his injuries have caused him to expend various sums of money on medical treatment.

The defendants in the lawsuit, who are listed as Smithkline Beecham Corp., Glaxosmithkline Consumer Healthcare, LLC, Glaxosmithkline Consumer Healthcare, LP, and the Block Drug Company, are accused of negligence, strict liability-design defect, strict liability-failure to warn, breach of implied warranties, violation of Pennsylvania’s Consumer Protection Act, common law fraud, and gross negligence and malice.

Taylor seeks relief as set forth in the Second Amended Master Long Form Complaint filed in the Denture Adhesive Cream Mass Tort Program in Philadelphia’s Common Pleas Court.

The plaintiff is demanding a jury trial.
