Marshalls faces personal injury claim for falling dressing room door incident

A Levittown, Pa. woman who alleges she sustained bodily harm after being injured by a falling dressing room door at a local Marshalls store is suing the company in state court.

Bensalem, Pa. attorney Marshall E. Kresman filed the personal injury lawsuit Aug. 24 at the Philadelphia Court of Common Pleas on behalf of Maureen Lorino and her husband, Clinton.

The defendants named in the suit are Marshalls, Inc., The TJX Companies, Inc., Marmaxx Operating Corp., Marmaxx Group, Inc., USA, and Federal Realty Investment.

According to the lawsuit, Maureen Lorino was shopping at the Marshalls store at 9169 Roosevelt Boulevard in Philadelphia on Sept. 11, 2009, when, while trying on clothes in the store’s dressing room, she became injured by a dressing room door that had fallen apart and landed on her.

The incident caused Maureen Lorino to sustain serious bodily injuries, including cervical disc bulges, protrusions and herniations, thoracic sprain and strain, right carpal tunnel syndrome, a severe shock to her nervous system and other physical injuries, the suit states.

Maureen Lorino has had to expend various sums of money on medical treatment, and she has been unable to carry out her usual duties and occupations because of her injuries, the lawsuit claims.

The complaint accuses the defendants of negligence for failing to outfit the dressing room door with the proper warnings, safeguards and other devices to ensure the safety of shopping customers.

The suit also faults Marshalls and the other defendants for failing to properly repair the door.

The plaintiffs seek judgment against the defendants in a sum in excess of $50,000, together with interest and court costs.

A jury trial has been demanded.
