Levittown, Pa. woman files denture adhesive cream mass tort claim

A Levittown, Pa. woman who alleges she sustained various physical injuries because she used denture adhesive cream for a number of years has filed a mass tort claim against companies involved in the manufacture and sale of the product.

Barbara Scholl, 63, claims in her lawsuit that her use of SuperPoligrip caused her to suffer numbness in her lower extremities, a left foot drop, tingling in her hands, a right wrist drop, finger drop on the left side, right foot drop, anemia, axonal neuropathy, elevated zinc levels, decreased copper levels, nerve weakness, muscle weakness, ambulation difficulty, balance difficulty and decreased strength and function of her hands.

The lawsuit, which was filed as a short-form complaint in the master denture adhesive cream litigation at Philadelphia’s Common Pleas Court, also alleges that Scholl suffered a loss of life’s pleasures, disfigurement, embarrassment and humiliation, lost wages, medical expenses and future monitoring expenses.

The suit claims that Scholl started using the denture adhesive cream in 1996 and has continued through to present day.

The complaint, which was filed Jan. 23 by Philadelphia attorney Howard J. Levin, names as defendants Smithkline Beecham Corporation, Glaxosmithkline Consumer Healthcare LLC, Glaxosmithkline Consumer Healthcare L.P., and Block Drug Company Inc.

The lawsuit accuses the various defendants of negligence, strict liability-design defect, strict liability-failure to warn, breach of implied warranties, common law fraud, gross negligence and malice, and violation of Pennsylvania’s Consumer Protection Act.

The suit also contains a loss of consortium count on behalf of the plaintiff’s spouse, Scott S. Scholl.

A jury trial has been demanded.
