A man in neighboring Delaware state has filed a mass tort Risperdal claim in Philadelphia’s Common Pleas Court, alleging he suffered injuries as a result of having taken the antipsychotic drug for a six-year period last decade and earlier this decade.
The plaintiff, identified in the suit only as “D.G.,” claims he developed Gynecomastia, or a development of enlarged breast tissue in men, as a result of his taking Risperdal from 2005 to 2011.
The lawsuit was filed April 19 by Philadelphia attorneys Stephen A. Sheller, Jamie L. Sheller and Brian J. McCormick, and Corpus Christie, Texas lawyers Thomas J. Henry and Michael E. Henry of the firm Thomas J. Henry Injury Attorneys.
The defendants named in the civil action are Ortho-McNeil-Janssen Pharmaceuticals, Johnson & Johnson Company, Johnson & Johnson Research and Development, LLC, Excerpta Medica, Inc. and Elsevier Inc.
The lawsuit, which was filed as a short-form complaint in the state court’s master Risperdal litigation, also states that the plaintiff’s mother, Jennifer Patillo, also of Bear, Del., claims damages as a result of her having incurred medical expenses in an effort to treat her son’s injuries.
The lawsuit accuses the defendants of negligence, fraud, strict product liability for failure to warn and design defect, breach of express and implied warranties and unfair and deceptive trade practices.
The complaint also contains counts of conspiracy and loss of consortium.
The plaintiff seeks unspecified compensatory and punitive damages.
