Phila. woman who sustained fracture after window fell on hand sues property manager

A Philadelphia woman who claims she sustained a broken hand after a window came crashing down on her while she was visiting a consignment shop located inside of her apartment building has filed a personal injury complaint against the property manager in state court.

Joan Meranze, who resides in an apartment within the condo complex at 2601 Pennsylvania Avenue in the Art Museum section of the city, is suing an entity called 2601 Parkway Condominium Association.

The civil action, which was filed on Meranze’s behalf May 7 at Philadelphia’s Common Pleas Court by Philadelphia attorney Kenneth M. Rodgers, claims that the plaintiff suffered a fractured right hand, nail bed laceration and crushed finger after a window at the Made You Look Consignment Shop, which is also a tenant of the mixed-use site, came crashing down on her hand.

The alleged incident, which occurred on June 17, 2011, was caused by a defective window, the lawsuit claims.

The complaint accuses the defendant of negligence for failing to properly maintain the premises and keep the windows in good repair, failing to warn invitees of the defective construction, and violating the Philadelphia Property Management Code.

The lawsuit claims that Meranze has incurred medical expenses related to the treatment of her injuries, and that she has suffered a loss of earnings and life’s enjoyments as a result of the incident.

Meranze seeks damages in excess of $50,000 plus a jury trial.
