A man from Delaware County who claims he was injured earlier this year after a cargo

handler at Philadelphia International Airport dropped freight on the plaintiff’s leg has filed a personal injury lawsuit against the worker and his employer in state court.

James Curley, Jr., of Marcus Hook, Pa., claims in his suit, which was filed June 14 at Philadelphia’s Court of Common Pleas by Boothwyn, Pa. attorney Christopher J. Heavens, that he suffered left ankle injuries after William Bramble, an employee with Worldwide Flight Services Inc., dropped cargo on the plaintiff’s extremity.

The alleged incident occurred on Feb. 17 of this year while Bramble was unloading freight in Cargo City, a building at Philadelphia International Airport.

The suit does not seem to specify whether the plaintiff was also an airport employee at the time of the incident, or whether he was simply a passerby.

The complaint does, however, say that the incident occurred in a restricted area, offering indication that Curley might have been a fellow employee of Bramble’s.

Both Bramble and Worldwide Flight Services, which is based at Philadelphia International Airport’s Cargo City, are named as defendants in the lawsuit, which contains counts of negligence and negligent hiring.

Curley accuses Bramble of failing to exercise reasonable care, failing to have a forklift under proper control, operating a forklift without due regard to the rights and safety of the plaintiff, failing to keep a reasonable lookout, failing to avoid contact with the plaintiff and negligence as a matter of law.

The suit claims Worldwide Flight Services is also partially liable for the injuries caused to Curley since the company had the right to control the manner of the performance of the work by Bramble.

As a result of the accident, Curley sustained unspecified injuries to his left ankle, the suit states. The plaintiff continues to suffer from pain and has difficulty performing his daily tasks.

Curley has also experienced mental anguish and emotional distress, the lawsuit claims.

Curley seeks damages in excess of $50,000 plus costs. He also demands a jury trial.
