Another Philadelphia plaintiff files asbestos mass tort in Phila. court

A Philadelphia man who was diagnosed last month with mesothelioma has filed a mass

tort asbestos claim at the Philadelphia Court of Common Pleas against a long list of companies that deal in asbestos-containing products.

Cherry Hill, N.J. attorney Mary Gaffney, of the firm Weitz & Luxenberg, filed the short-form complaint June 20 at state court on behalf of Allen and Linda Rosenberg.

It was the second time in a week that a Philadelphia plaintiff filed an asbestos claim in a Philadelphia courthouse.

The suit, which was filed as a short-form complaint in the master asbestos docket, alleges that Allen Rosenberg’s mesothelioma diagnosis was a direct result of his having worked around asbestos during his career.

Rosenberg worked various salesman jobs at companies such as Rohm & Haas, BP Oil Refinery, US Steel, Croydon Cement Company and National Chemsearch.

The plaintiff also worked on renovating homes for a 10-year period.

Rosenberg, who is 69 years old, received his mesothelioma diagnosis on May 7 of this year by doctors at the University of Pennsylvania Health System in Philadelphia, the suit states.

The defendants named in the civil action include, but are not limited to, Owens Illinois Inc., Hess Corp., American Biltrite Inc., Borg-Warner Corp., Certainteed Corp., Crane Co., DAP Inc., General Electric Co., Georgia Pacific LLC, Honeywell International Inc., Rohm & Haas, and Yarway Corp.

The plaintiffs seek damages as set forth in the master asbestos litigation at Philadelphia Common Pleas Court.
