A municipal waste collector from Lower Bucks County who claims he was injured after
the recycling truck he was working on accidentally ran him over has filed a lawsuit against the truck’s manufacturer and others in state court.
Langhorne, Pa. attorney Todd M. Sailer, of the firm Begley Carlin & Mandio, filed the injury claim June 27 at the Philadelphia Court of Common Pleas on behalf of Levittown resident Richard Millward.
The defendants named in the lawsuit are California-based MBB Palfinger, Iowa-based Omaha Standard Inc., Omaha Standard Inc. of New Jersey, which does business as Palfinger American Roll-off, Alabama-based PalFleet Truck Equipment Co. and Ohio-based Tiffin Loader Crane.
According to the complaint, Millward was seriously and permanently injured on June 28, 2010, after he was partially run over by the Model GS-3000 Recycling Truck he was riding in at the time during the scope of his employment with McCullough Rubbish Removal Inc. of Levittown.
Millward and his coworkers were collecting recycling items in a residential area in Bensalem Township at the time of the incident.
Millward was standing on a foot step on the driver’s side of the truck when, after the truck lurched forward, he fell from the truck and landed under or in front of the driver’s side wheel of the truck, according to the lawsuit.
It was at this time that Millward was run over by the vehicle.
The lawsuit accuses the defendants of strict liability for manufacturing, promoting, selling, merchandising, distributing, delivering and supplying a truck in a defective condition.
As a result of the incident, Millward sustained various injuries, including multiple pelvic fractures, multiple leg injuries, abrasions, groin abscess and infection, shoulder injuries, sciatic neuropathy and other bodily ills.
Millward has undergone great physical pain and mental anguish as a result of the accident, the lawsuit states, and he incurred great sums of money for the medical care and treatment of his injuries.
In addition to the strict liability count, the lawsuit also contains a count of negligence against the various defendants.
Millward seeks damages in excess of $50,000, together with interest and costs.
A jury trial is being demanded.
