Financial co. Pitney Bowes sues Phila. printer for breach of lease

Global financial services firm Pitney Bowes has filed a civil action against a Philadelphia-based commercial printing company, alleging the defendant breached a lease with the plaintiff after the business failed to make the appropriate payments on leased equipment.

Kingston, Pa. attorney Richard W. Keifer, III, filed suit on behalf of Jacksonville, FL-based Pitney Bowes Global Financial Services, as successor in interest to Pitney Bowes Credit Corp., seeking the repayment of close to $30,000, relating to an equipment rental lease between the plaintiff and Philadelphia-based Abbi Print LLC, which is located at 5338 W. Columbia Avenue.

According to the complaint, the two entered into a lease agreement in late April of last year by which Pitney Bowes would provide commercial printing equipment in return for quarterly payments in the amount of $3,225.

On Feb. 17 of this year, Abbi defaulted by failing to make its scheduled payments, the lawsuit claims.

“Despite repeated demands, Defendant has failed and refused to make the payments due under the Lease from and said defaults have not been cured or waived,” the suit reads.

The complaint alleges that Abbi owes Pitney Bowes $24,763.33 in unpaid balance.

The suit also states that the lease provides for attorneys fees and costs, and Pitney Bowes is seeking legal fees in the amount of $4,952.66, representing 20 percent of the amount owed.

In total, the plaintiff seeks to recover from Abbi $29,715.99, together with interest and costs.

Arbitration in the matter has been scheduled for March 15, 2013.
