A motorist who claims he was recently injured after a Philadelphia Police patrol car

crashed into his vehicle has filed a personal injury claim against the law enforcement agency and the cop who was behind the wheel of the squad car during the collision.

Philadelphia attorney Anthony R. Giannone, of the firm Lashner Parker & Giannone, filed the civil action July 23 at the Philadelphia Court of Common Pleas on behalf of James Grimes.

The two defendants named in the suit are the Philadelphia Police Department and Police Officer Joseph Moore.

Mere days before the filing of the complaint, Grimes was traveling along the 600 block of E. Erie Avenue in Philadelphia when his vehicle was suddenly, and without warning, struck by a police patrol car operated by Officer Moore, the lawsuit alleges.

Moore had been pulling out of a driveway or an intersection at the time of the crash.

The accident caused Grimes to be “violently thrown from his position,” and to sustain a variety of serious bodily injuries, including multiple fractures, torn ligaments of the left knee, a fractured hip, a shock to his nervous system and other ills and injuries, the lawsuit claims.

Grimes has been obliged to spend various sums of money on medical attention to cure his injuries, and he has suffered a loss of earnings as a result of the incident, the suit states.

The complaint accuses the defendants of negligence and carelessness for failing to maintain an adequate lookout, failing to regard the point and safety and position of the plaintiff, operating a vehicle at an excessive speed, failing to regard traffic controls, failing to signal the intentions of the patrol vehicle, failing to yield to other vehicles at an intersection, and failing to warn the plaintiff of the impending collision.

For each of the two counts listed in the injury lawsuit, Grimes seeks more than $50,000 in damages.
