A North Carolina woman who claims she sustained bodily injuries after having taken the
birth control drug Yaz for a four-year period has filed a pharmaceutical mass tort claim against the manufacturers of the product in a Pennsylvania court.
Denise J. O’Connor, 41, of Morrisville, N.C., claims in her civil action that she was diagnosed earlier this year with pulmonary embolisms, injuries she claims were directly attributed to her use of the birth control medication.
The lawsuit, filed as a short-form complaint in the master Yaz, Yasmin, Ocella, Gianvi litigation at Philadelphia’s Common Pleas Court Aug. 8 by attorneys with Philadelphia-based Kline & Specter, states that O’Connor took Yaz from 2008 to 2012.
The defendants named in the complaint are Bayer Corp. and various company subsidiaries, Berlex Laboratories Inc., and Berlex Inc.
The suit contains counts of fraudulent concealment, strict liability, breach of implied warranty of merchantability, breach of implied warranty of fitness for a particular purpose, negligent failure to warn, negligent design defect, negligence, negligent misrepresentation, breach of express warranty, fraud and violations of consumer protection laws.
The plaintiff seeks damages as set forth in the master Yaz, Yasmin, Ocella, Gianvi litigation.
