A Philadelphia man is suing a relative of his over claims that a property that had belonged to his deceased parents was fraudulently conveyed to the defendant long after the couple died.

Richard Jackson, who is the administrator of the estate of his late mother, Sallie Jackson, filed suit at Philadelphia’s Common Pleas Court Aug. 27 against a Philadelphia woman identified as Nancy Jackson Cooper.

The suit does not explain the exact nature of the relationship between the plaintiff and the defendant.

According to the complaint, at the time of her death in mid June 1993, Sallie Jackson, was the sole owner of a property at 1006 S. 11^th St. in Philadelphia.

The woman had lived at the home with her husband, Richard Jackson, Sr., who had preceded her in death in November 1991.

In August 2007, Nancy Jackson Cooper was allegedly fraudulently conveyed the property, the lawsuit claims, since the couple were both dead at the time of the conveyance.

In mid December 2011, the City of Philadelphia initiated litigation against Nancy Jackson Cooper for a real estate tax lien; the suit named Jackson Cooper as the owner of the property in question.

In early June of this year, a state judge in Philadelphia entered an order allowing the property to be sold at sheriff’s auction, clear of all claims and liens, and on Aug. 15, the property was sold for $145,000 to the highest bidder, a company called RBT Pemberton Properties, the record shows.

In mid May of this year, the state Department of Revenue’s Bureau of Compliance filed a certified copy of an inheritance tax lien in the amount of $66,973.83 against the estate, according to the complaint.

Through his lawsuit, Richard Jackson seeks to have a court enter a judgment ordering the Philadelphia Recorder of Deeds to convey the property to the plaintiff.

The plaintiff also desires to have the Philadelphia Sheriff pay the balance of the sale proceeds to the estate of Sallie E. Jackson and not to Nancy Jackson Cooper, who, the suit claims, is not and never was the legal owner of the property.
