A Lehigh Valley couple has filed a personal injury complaint against the Girl Scouts of
America and local affiliates over claims that their young daughter became injured during an organizational outing this past spring.
Media, Pa. lawyer Thomas F. Sacchetta filed the civil action Aug. 31 at the Philadelphia Court of Common Pleas on behalf of Stephen and Marsha Bagosy of Effort, Pa.
The defendants named in the litigation are Girl Scouts of the USA, Girl Scouts in the Heart of Pennsylvania, Girl Scouts of Greater Philadelphia Inc., Girl Scouts of Eastern Pennsylvania and Kingsley, Pa.-based Camp Archbald.
The latter was the location of the alleged April 21 incident in which the plaintiffs’ minor daughter sustained injuries to her head, neck, back and extremities.
The lawsuit does not specify the exact nature of the accident, only offering that the plaintiffs have incurred medical expenses to treat their child’s extensive injuries.
The child, who is now 12 years old, was a Girl Scout at the time of the incident at Camp Archbald, which is located in Northeastern Pennsylvania almost at the New York state line.
The complaint contains various counts of negligence against each named defendant.
The plaintiffs accuse the defendants of failing to properly train employees, failing to use reasonable care in the maintenance and repair of the camp premises, failing to protect the minor child from harm, failing to immediately contact emergency response teams and/or obtain medical care to minimize injury to the young girl, failing to properly investigate and select proper supervisors for scout outings, allowing a defective condition to remain for an unreasonable period of time, failing to monitor and supervise the child so as to ensure her safety, and acting carelessly, recklessly, wantonly and with disregard for the health, safety and welfare of the minor plaintiff.
The suit claims that the young girl may have suffered a permanent disability and permanent impairment of future earning power as a result of her injuries.
The plaintiffs seek compensatory damages in excess of $50,000.
A jury trial has also been demanded.
