Obermayer Rebmann sues former client for breach of contract

A Philadelphia law firm has filed a breach of contract suit against a Pennsylvania

corporation that operates nursing home facilities over claims that the defendant has failed to fully compensate the plaintiff for legal services.

Obermayer Rebmann Maxwell & Hippel initiated the litigation against Haverford, Pa.-based Cambridge Brightfield Associates LP, Cambridge Brightfield GP LLC and The Cambridge Companies over allegations that the defendants have failed to pay the plaintiff $52,774.27 in outstanding legal fees.

The lawsuit, which was filed Sept. 6 at the Philadelphia Court of Common Pleas by Obermayer Rebmann attorney Catherine M. Chan, states that the parties entered into an agreement in early March 2009 whereby the law firm would provide legal services to the defendants in connection with an appeal of a decision by the Pennsylvania Department of Welfare regarding a license revocation, and providing representation regarding licensing, regulatory and compliance issues.

A written fee agreement setting forth the terms of the representation and billing, was prepared by the law firm and accepted by the defendants, the complaint states.

“Obermayer fully and satisfactorily performed its obligations under the agreement by providing valuable legal services to Defendants and incurring costs on Defendants’ behalf …,” the lawsuit states.

The law firm claims that the defendants owe it the outstanding balance plus a 1 percent late charge through April 2012.

Obermayer Rebmann seeks damages in excess of $50,000, plus interest, costs, attorney’s fees and other appropriate court relief.
