Phila.'s Delilah's Den gentleman's club faces personal injury claim by guest

A Pennsylvania man who claims he was rendered unconscious and suffered severe head

and facial injuries after being attacked inside a Philadelphia gentleman’s club last summer has filed a personal injury claim against the establishment.

Philadelphia attorney I. Michael Luber filed suit at Philadelphia’s Common Pleas Court Sept. 12 on behalf of Harper Myers of Enola, Pa.

The defendant named in the civil action is Delilah’s Den of Philadelphia Inc.

According to the complaint, Myers was standing inside the defendant’s business back on Aug. 14, 2011, when he was suddenly attacked by bar personnel, including bouncers, who worked for Delilah’s, which is located at 100 Spring Garden Street.

Myers ended up being knocked to the ground and rendered unconscious after he was struck in the face and head, the lawsuit claims.

Myers sustained a right orbital fracture, bony displacement, facial lacerations and a closed head injury, all of which required medical attention, the suit states.

The lawsuit contains counts of negligence, negligent security and/or supervision and assault and battery.

Myers accuses the defendants of various acts of negligence, such as failing to use adequate and proper restraint with regard to contact with the plaintiff, failing to obey and follow proper procedures and policies established by the defendant, using excessive force and failing to use due care under the circumstances.

The lawsuit claims that Myers sustained other injuries as a result of his ordeal, including abrasions, contusions, mental anguish, emotional and psychological injuries and other ills.

The plaintiff also claims he has been hindered from attending to his daily duties, functions, occupations and activities, and that he has had to spend various sums of money on medical attention.

Myers seeks $50,000 in damages, exclusive of interest and costs.
