Midlantic Medical Transport sued by mother of juvenile pedestrian struck by emergency vehicle

The mother of a juvenile who was injured after being struck by a private ambulance while the boy was crossing the street two years ago has filed a personal injury complaint against the driver and the agency for which she worked.

The lawsuit, which was filed Sept. 21 at the Philadelphia Court of Common Pleas by Philadelphia attorney David B. Sherman, alleges that Monique Murray’s minor son was seriously injured back on Dec. 9, 2010, while crossing Fisher Street at the intersection with 10th Street in Philadelphia.

At the time, the boy was struck by a motor vehicle being operated by Jessica Mendez and belonging to Midlantic Medical Transport Inc.

As a result of the incident, the boy sustained injuries to his head, face, mouth, neck, knees and surrounding body parts.

The injuries included multiple abrasions, contusions, hematomas to the head and face, dental fractures, scarring and other injuries, the lawsuit states.

The minor also suffered humiliation, embarrassment, emotional distress and a loss of life’s pleasures.

The mother, the plaintiff in the case, claims she was required to spend large sums of money on medical attention to treat her son’s injuries.

The lawsuit accuses the defendants of carelessness, negligence and recklessness for operating a motor vehicle at an excessive rate of speed, failing to have a motor vehicle under proper and adequate control, failing to give proper and sufficient warning of the approach of the motor vehicle and failing to keep a proper lookout.

While the vehicle in question appears to be an ambulance, the lawsuit does not state whether or not the emergency vehicle was en route to a call at the time of the accident.

The plaintiff seeks compensatory damages in excess of $50,000, plus attorney’s fees, costs and other court relief.
