A prestigious Philadelphia school is facing a lawsuit by a student who claims he sustained
a “significant” laceration to his forehead two years ago after falling against a gate surrounding the perimeter of the rooftop playground area of the property.
Philadelphia attorney Ciro Tufano, of the firm Madden & Tufano LLC, filed the personal injury complaint Sept. 24 at Philadelphia’s Court of Common Pleas on behalf of April Scott, whose minor son allegedly became injured during a May 2010 incident at the J.R. Masterman Laboratory and Demonstration School, which is located at 1699 Spring Garden St.
The civil action states that the young student became injured as a result of coming into contact with an allegedly defective gate that surrounds a rooftop play area at the school.
The boy ended up sustaining head trauma, a closed head injury, scarring and alopecia, the lawsuit claims.
He also suffered, and continues to suffer, great pain and discomfort.
The student’s mother has suffered financial detriment due to the fact that she had to pay for hospital and medical bills in an effort to cure her son, the suit states.
The plaintiff accuses the school of negligence, carelessness and recklessness for failing to warn users of the dangerous condition, failing to correct a defective condition, disregarding the rights and safety of the minor plaintiff, and failing to use due care under the circumstances.
The plaintiff seeks compensatory damages in excess of $50,000, together with interest, litigation costs and other court relief.
The Philadelphia School District and the City of Philadelphia are also named as defendants in the litigation.
