Guest who fell through fourth floor glass window files suit against Phila. hotel

A South Philadelphia hotel is facing a personal injury claim by a former guest who alleges

he had to have reconstructive surgery after he fell through one of the windows at the place of lodging.

Philadelphia attorney Nicholas L. Palazzo filed the personal injury complaint Oct. 15 at the Philadelphia Court of Common Pleas on behalf of city resident James Nelli.

The defendants named in the suit are the Skyview Plaza Hotel & Suites and Vraj Brig PA LLC, which is the hotel’s owning entity.

According to the complaint, Nelli was a guest at the hotel back in October 2010 when, after tripping on the foot of the bedpost, he placed his hand on his hotel room window, at which time the glass shattered and caused Nelli to fall through the window of the fourth-floor room.

The incident caused Nelli to sustain severe lacerations to his chest and stomach, injuries that required reconstructive surgery, the suit claims.

As a result of the ordeal, Nelli also experienced severe pain and suffering, mental anguish, depression, post-traumatic stress and permanent scarring and disfigurement, the complaint alleges.

Nelli was forced to spend various sums of money on medical attention and he has been prevented from attending to his usual duties and activities.

The lawsuit accuses the defendants of negligence for failing to properly test and inspect the window panes in the hotel rooms to ensure that they were safe; failing to install window panes that would be able to withstand a significant amount of pressure; and installing single-pane windows.

For each of the two counts of negligence listed in the lawsuit, the plaintiff seeks damages in excess of $50,000.
