A New Jersey woman is suing a truck driver and his employers over claims
that she sustained back problems and other injuries after her vehicle was struck by a tractor-trailer driven by the defendant two years ago.
Philadelphia attorneys Joan D. Gallagher and Joseph P. Turchi, of the firm Gallagher, Mallow, Georges P.C. filed suit Oct. 25 at the Philadelphia Court of Common Pleas on behalf of Bridgeport, N.J. resident Cynthia Bradbury, who claims she was injured on Nov. 30, 2010, after her 1999 BMW sedan was sideswiped by a 2011 International Harvester Tractor-Trailer driven by James Sutterby.
Sutterby was an employee of RIST Transportation, Wadhams Enterprises and/or ARG Trucking at the time of the accident.
All are named as defendants in the civil action.
The accident, which happened along Interstate 95 near Exit 2 in Delaware County, Pa., occurred after Sutterby suddenly switched lanes and struck the left quarter panel and left rear of the plaintiff’s vehicle, according to the complaint.
The suit alleges that as a result of the accident, Bradbury sustained a broad-based disc herniation, burning, numbness and pain in her cervical spine that radiates into her arms and hands.
The plaintiff also allegedly suffered from strains and sprains of the cervical, thoracic and lumbar spine, muscle spasms, severe post-traumatic stress syndrome, decreased mobility and a shock to her emotional, psychological and nervous systems, all of which have caused her great pain and anxiety.
Bradbury has had to spend various sums of money on medical and therapeutic care, and she has suffered a loss of function and a reduction or loss of life’s enjoyment, and an inability to work and carry out daily activities, the suit claims.
The complaint accuses the defendants of negligence, carelessness and recklessness for making a dangerous lane change, failing to look for traffic, operating a large tractor-trailer in a reckless manner and failing to be cognizant and aware of surroundings on the road.
Bradbury seeks compensatory damages in excess of $50,000, plus interest, costs and delay damages.
The plaintiff also seeks unspecified punitive damages for the alleged willful, wanton and outrageous conduct on the part of the defendants.
