Strasburg, Pa. Railroad Co. and historical museum face personal injury claim

A Northwestern Pennsylvania woman has filed a personal injury claim against the

Lancaster County-based Strasburg Railroad Co. and its historical museum over allegations that she sustained wrist and leg fractures after she fell at the location.

Janet King, who resides in Erie, Pa., alleges in her civil suit that while visiting the railroad museum back on Oct. 8, 2011, she tripped and fell on a walkway she claims was constructed of wooden boards containing large gaps and significant changes in elevation.

The walkway allegedly had no guardrail or barrier to prevent invitees from falling into the gaps in the ground, the suit claims.

The complaint, which was filed Nov. 29 at the Philadelphia Court of Common Pleas by Yardley, Pa. attorney R. Tyler Tomlinson, of the firm Stark & Stark, P.C., alleges that as a result of her fall, King sustained fractures to her left wrist, left elbow and left leg, all of which required surgical repair.

King also sustained injuries to her head, neck, back, and organs, as well as a shock to her nervous system, the complaint states.

The plaintiff had to spend money on medical care and she also suffered monetary loss in the form of lost wages due to her inability to work because of her injuries, the lawsuit says.

The three defendants, the Strasburg Railroad Company, the Friends of the Railroad Museum and the Railroad Historical and Educational Foundation of Strasburg, are all accused of negligence, carelessness and recklessness for allowing a dangerous condition to remain on the premises and failing to correct and maintain the danger.

King demands more than $50,000 in damages, in addition to the costs of the lawsuit, interest and attorneys’ fees.
