Phila. woman sues Longhorn Steakhouse over broken wrist, back injuries

A suburban Philadelphia woman who says she sustained a broken wrist after falling

inside of a local Longhorn Steakhouse restaurant has filed a personal injury complaint against the eatery and its parent company in federal court.

Attorney J. Davy Yockey, of the Trevose, Pa. firm Flager & Yockey, P.C., filed the civil action Jan. 14 at the U.S. District Court for the Eastern District of Pennsylvania on behalf of his client, Linda J. Matthews, who resides in Langhorne, Bucks County.

The defendants named in the suit are Rare Hospitality International Inc., which does business as Longhorn Steaks Inc., Darden Restaurants, Darden Restaurants of PA Merger Corp. and GMRI Inc.

In her complaint, Matthews claims while visiting the Longhorn Steakhouse location at 100 Rockhill Drive in Bensalem, Pa., she was caused to fall due to a “dangerous step down condition within the premises.”

The fall allegedly caused Matthews to suffer a fractured wrist, back injuries, and other physical ills, the lawsuit claims.

The plaintiff ended up incurring various sums of money due to her necessary medical treatment, and she suffered mental anguish, emotional trauma and other non-economic and economic losses due to the incident, her complaint alleges.

The defendants are collectively accused of negligence for failing to give Matthews proper notice of the dangerous condition within the restaurant, failing to place warnings or “adequate visual cues” at the point of the dangerous condition so as to prevent the occurrence, failing to provide adequate lighting, and for improper design and maintenance of the premises.

Matthews seeks judgment against the defendants in an amount in excess of $75,000, plus interest, the costs of the litigation and delay damages.
