Kennett Square nursing home named in wrongful death suit

The husband of a nursing home resident is suing over claims the facility's alleged negligence resulted in his wife's death.


Robert F. Hemmerle, husband of Mabel E. Hemmerle, filed a lawsuit Feb. 24 in the Philadelphia County District Court against Genesis Healthcare LLC and 184 Bethlehem Pike Operations LLC, doing business as Fairview Care Center of Bethlehem Pike, citing negligence and loss of companionship.

Hemmerle claims the defendants, 101 E. State St. in Kennett Square, failed to properly care for their resident, Mabel, while she was staying at the facility. The suit alleges Mabel suffered many illnesses and injuries, including skin tears, pressure ulcers, pneumonia and a fall that resulted in multiple fractures, laceration and hematoma to the left eye. According to the complaint, the deterioration caused by the defendants' negligence led to her untimely death.

Hemmerle is seeking damages in excess of $50,000, punitive damages and court costs. The plaintiff is being represented by David G. Pribyl of Dudley and Lake LLC.
