CSX Transportation has filed a civil action against Delaware-based
Megatrux Transportation Inc. over claims that the defendant has failed to pay close to $45,000 in rail common carrier freight charges.
According to the complaint, which was filed on April 4 at the U.S. District Court for the Eastern District of Pennsylvania, Megatrux incurred a total of $44,849 in rail freight charges relating to an agreement it entered into with CSX whereby the plaintiff would transport freight via interstate rail at the request of the defendant.
CSX carried out its share of the agreement from October 2013 through this past February, the lawsuit states, after which it presented freight bills for the work to Megatrux.
Despite demand, however, Megatrux has thus far refused to make payments to CSX, the complaint states.
The plaintiff seeks judgment in its favor in the amount of freight charges it says it is owed plus costs, interest and attorneys’ fees.
The complaint was filed by attorneys Benjamin C. Mann and Jeffrey D. Cohen of the Jenkintown, Pa. firm Keenan Cohen & Howard.
The federal case number is 2:14-cv-01994-LS.
