A Pennsylvania woman has filed a personal injury complaint against a New
Jersey-based eatery over allegations that she broke her leg in the parking lot of the defendant’s suburban Philadelphia location.
Eileen Pardys and her husband, Aaron, filed suit at the Eastern District of Pennsylvania on April 14 against Italian Peoples Bakery Inc. over a June 13, 2013, incident at the defendant’s property in Levittown, Pa. in which Eileen Pardys, while exiting her vehicle, suddenly and without warning tripped over a high, uneven curb, causing her to fall and sustain severe and permanent bodily injuries.
The plaintiff ended up needing surgery to repair her right tibia and fibula fractures, the complaint states.
She also experienced nervous system shock, anxiety and mental anguish.
Pardys says she incurred a vast sum of medical bills and she suffered earnings losses due to her inability to work due to her injuries.
The defendant is accused of negligence for carelessly allowing the curb on the premises to be kept in a dangerous condition for a prolonged period of time, failing to inspect the premises and make proper corrections, and failing to warn people upon the premises of the dangerous condition.
A codefendant in the litigation, Robert C. Juliano, of Mt. Laurel, N.J., also stands accused of negligence for his alleged role in the incident.
The exact nature of Juliano’s position with the bakery is not spelled out in the complaint, although it appears that he may be the business’s owner.
The suit also contains a loss of consortium count on behalf of Aaron Pardys, the plaintiff’s spouse.
The couple seeks more than $150,000 in compensatory damages as well as interest, attorneys’ fees and other relief.
They are being represented by Newtown, Pa. attorneys Brandon A. Swartz and Joseph P. Guzzardo of the firm Swartz Culleton P.C.
