A Lehigh County man has filed a personal injury suit in the Philadelphia Court of Common
Pleas against Walmart for a shoulder injury he sustained while delivering a package at the company's Pottsville store in Schuylkill County.
Thomas Patterson, of Laurys Station, Pa., seeks compensatory and punitive damages in excess of $50,000 from the retail chain, claiming negligence on the store's part led to his injury. His wife, Lynn, has also filed for loss of consortium with Patterson, saying the employees' recklessness deprived her of Patterson's companionship.
According to the complaint, Patterson arrived at the Pottsville Walmart on December 16, 2013, to deliver a package to the warehouse department. While making the delivery, Patterson tripped over a metal plate protruding from the floor. The fall caused Patterson to dislocate his shoulder, an injury that required regular doctor visits for treatment, the suit claims.
Patterson says that Walmart employees failed to ensure a safe environment for business invitees by allowing a hazardous condition to exist on the premises.
The plaintiff is represented by Leonard Fodera of Fodera & Long in Philadelphia.
