PHILADELPHIA – A contract dispute between a Pennsylvania-based technology company and one of its former executives, Scott Kurtz, has resolved itself without admission of liability, per counsel for the defense.
Both sides had filed complaints in the U.S. District Court for the Eastern District of Pennsylvania in February claiming the other had breached employment agreements and competition clauses. However, in a March 4 motion to dismiss, Adaptive Digital Technologies alleged Kurtz's complaint "suffers from a series of flaws, including lack of standing, time bar, and failure to plead elements of the causes of action.”
One day after the plaintiffs filed an amended complaint, Judge Mark A. Kearney dismissed the suit without prejudice on April 2.
