Customer alleges negligence in slip-and-fall accident at Big Lots

PHILADELPHIA - A retail patron and her husband are suing a store, alleging she suffered injuries after falling on a wet floor.

Theresa McManus and Daniel McManus of Levittown filed a lawsuit June 16 in U.S. District Court for the Eastern District of Pennsylvania against Big Lots of Columbus, Ohio, alleging negligence.

According to the complaint, on June 18, 2013, Theresa McManus was on the premises of Big Lots, 2645 Durham Road in Bristol, when she slipped and fell on a wet and slippery floor while walking toward the restrooms near the front of the store. The plaintiff faults the defendant with allowing and causing a dangerous and defective condition to exist.

McManus alleges she suffered severe and permanent injuries as a result of the fall. Her husband Daniel says the accident led him to lose society, companionship, support and consortium of his wife.

The plaintiffs seek damages in excess of $150,000, plus attorney fees and costs. They are represented by attorney Alan F. Galerman of Galerman,Tabakin & Wolfe in Philadelphia.
