Health care company seeks payment for services

READING - A Pennsylvania company is suing an Ohio residential health care facility, alleging failure to to pay for requested services.

Healthcare Services Group Inc. filed a lawsuit June 26 in U.S. District Court for the Eastern District of Pennsylvania against The Mary Scott Nursing Home, doing business as Mary Scott Nursing Center in Dayton, Ohio, alleging breach of contract.

According to the complaint, the defendant entered into a dietary services and housekeeping service agreement with HSG in June 2013, and the dietary services agreement stated HSG would provide food services on the premises of the health care facility, including therapeutic diets for patients, for a monthly cost of $41,095.24. As part of the agreement, the suit says, HSG also would provide items used in the service of food such as silverware and purchase non-prescription oral supplements.

The housekeeping services agreement stated HSG would provide housekeeping and laundry services, including the repair and addition of housekeeping equipment, for a monthly cost of $16,946.43, the lawsuit states, and both agreements would be in effect until any party canceled them 120 days after the services began, after giving a 90-day written notice of intent to terminate.

The plaintiff alleges the defendant has breached its contractual duties and owes $107,798.44 for dietary services and $17,799.97 for housekeeping services.

HSG seeks a total of $124,744.87 for its services to Mary Scott Nursing Center, in addition to attorney fees and court costs. It is represented by attorneys Steven Adams and Craig Hirneisen of Stevens & Lee in Reading.
