Staten Island couple sues casino, alleging injuries from intoxicated patron

A married couple from Staten Island is suing a Bensalem casino gaming complex, alleging injuries sustained at the hands of an intoxicated patron.

Paul and Kristi Devaney of Staten Island filed a lawsuit July 27 in U.S. District Court for the Eastern District of Pennsylvania against Parx Casino in Bensalem, alleging negligent hiring and supervision, violations of the Pennsylvania Dram Shop Act and loss of consortium.

According to the complaint, on Feb. 23, 2014, the Devaneys were at the casino when Paul Devaney was struck with a glass bottle by a patron who was visibly intoxicated. The suit states Paul Devaney endured serious and possibly permanent injuries as a result of the attack and has and will continue to receive medical attention and care.

The suit faults the defendant for failing to protect the safety of its patrons by not removing visibly intoxicated guests and allowing its employees to serve alcohol to patrons who were intoxicated. In the filing Kristi Devaney also says she has lost the assistance, society and companionship of her husband as the result of the defendant's negligent and careless actions.

The Devaneys seek damages for physical pain, mental anguish, physical disfigurement and impairment, medical care and treatment, lost wages, the inability to participate in normal activities and loss of consortium. They are represented by attorney Bruce Martin Ginsburg of Ginsburg & Associates in Philadelphia.
