Customer sues Dollar General, alleging negligence in fall

An Effort man is suing Dollar General, alleging injuries sustained in a 2014 fall at one of chain's stores.

Rickey Zito filed a lawsuit July 28 in the U.S. District Court for the Eastern District of Pennsylvania against Dollar General Corporation, alleging negligence and carelessness.

According to the complaint, on Aug. 12, 2014, Zito was shopping at the Dollar General store in Brodheadsville when he tripped and fell as the result of metal shelving being left on the floor. The suit states Dollar General failed to ensure its premises were safely maintained, warn Zito of a dangerous conditions or correct the dangerous condition.

The plaintiff alleges he has and will continue to endure severe physical pain, mental anguish, inconveniences with regards to his everyday activities, loss of earning capacity, and medical expenses.

Zito seeks compensatory damages, attorney fees, court costs and other relief deemed appropriate by the court. He is represented by attorney Andrew J. Schneider of Silverman Trotman & Schneider in Philadelphia.
