Nurse sues Pro Care Medical Staffing, alleging unpaid overtime

A Montgomery County licensed practical nurse is suing his former employer over unfair pay practice claims.

Yahya Muhammad filed suit against Pro Care Medical Staffing LLC in the U.S. District Court for the Eastern District of Pennsylvania on Sept. 29, citing violations of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, Muhammad was employed at the defendant's Inglis House in Philadelphia from 2013 to November 2014. Muhammad worked a regular rate of $29 an hour over a 40-hour work week but was never paid the compensation rate of one-and-one-half times for overtime work, the complaint states. For example, during the work period ending in Nov. 16, 2014, he worked 68 hours, and during Nov. 23, 2014, he worked 56 hours and was not paid an overtime rate.

Muhammad is seeking compensation for all of his overtime hours that he was not properly compensated for, as well as all legal fees resulting from this matter. Muhammad is represented by Peter Winebrake, R. Andrew Santillo, and Mark J. Gottesfeld of Winebrake & Santillo LLC in Dresher.
