A New York woman is suing both a Pennsylvania-based supermarket chain and a ceiling contractor over injuries she allegedly sustained while shopping at one of the chain's stores.
Cheryl L. Warfield filed a lawsuit Sept. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Weis Markets Inc. and Quality Ceilings Inc., alleging negligence.
The suit states that Warfield was grocery shopping at Weis Markets' Danville location on around Sept. 11, 2013, when a liquid spray containing toxic chemicals shot from a mechanical arm being operated by an agent or employee of Quality Ceilings, in the process of ceiling tiles of the supermarket, and got into Warfield's eyes, causing a painful and burning sensation. Warfield experienced serious injuries to both of her eyes including irritation, blurred vision and dry eye syndrome. She had to have her eyes flushed and be treated for chemical exposure, as well as receive ongoing treatment from an eye specialist.
According to the complaint, the defendants are faulted with allowing individuals to use dangerous chemicals during regular stores hours and in the presence of customers, failing to warn business patrons of the unsafe condition, and failing to take appropriate precautions to ensure the safety of its customers.
Warfield claims, in the civil action, she has and will continue to endure pain, mental anguish, the inability to partake in daily activities, loss of enjoyment in life, and medical expenses.
Warfield seeks damages of more than $75,000, plus court costs and other relief deemed appropriate by the court. She is represented by attorney Clayton H. Thomas Jr. of Wade Clark Mulcahy in Philadelphia.
