The Walgreen Co. has filed a motion seeking to remove a wrongful termination lawsuit from Pennsylvania state court to federal court.

On Oct. 6 lawyers for Walgreen's filed a motion seeking to remove the wrongful termination lawsuit of Kris Clarke, currently pending in the Court of Common Pleas of Northampton County, to the U.S. District Court for the Eastern District of Pennsylvania. Walgreen's argues that because it is an Illinois company, this case should be in federal court because of the principal of diversity.

Clarke was terminated on Jan. 7, 2014, believing the termination was in retaliation for reporting the alleged unlawful secret recording of his work place conversations, according to the complaint.

Sara A. Begley and Anne E. Rollins of Reed Smith LLP of Philadelphia are representing the plaintiff.

U.S. District Court for the Eastern District of Pennsylvania case number 15-cv-05503.
