Insulators Local 23 Pension Fund files against Loshaw Thermal Tech over unpaid contribution claims

Trustees of a pension fund are suing a Spring Grove business, alleging that the company has not contributed to the plan in several years.

William McGee and Scott Jensen, trustees for the Insulators Local 23 Pension Fund, Insulators Local No. 23 Annuity Fund and Insulators Local Nov. 23 Health and Welfare Fund filed a lawsuit against Loshaw Thermal Tech LLC of Spring Grove on Sept. 29 in the U.S. District Court for the Middle District of Pennsylvania, citing violations of Employee Retirement Income Security Act and breach of the collective bargaining agreement executed between the parties.

The complaint alleges that since 2011 the defendant, a heat and frost insulation company, has failed to make roughly 3,800 hours in union employee pension benefit contributions. The plaintiff alleges these contributions are required under federal ERISA laws, and the collective bargaining agreement executed between the parties.

The plaintiff seeks compensatory damages, plus attorney fees, liquidated damages, and costs of litigation. Attorney Charles W. Johnston of Camp Hill represents the plaintiff.
