Woman sues Progressive Insurance Co. to collect underinsured motorist benefits

An Abington woman is suing an insurance company in an attempt to collect her underinsured motorist benefits following a serious motorcycle accident.

Tracy Godshalk filed against Progressive Insurance Co. on Sept. 17 in the U.S. District Court for the Eastern District of Pennsylvania, seeking compensatory relief.

According to the complaint, Godshalk was a passenger on a motorcycle traveling westbound on Lancaster Avenue in Frazer on Oct. 6, 2012, when her leg was directly struck by another vehicle exiting a parking lot and she was thrown from the motorcycle. The complaint states that the motorcycle's owner had an underinsured motorist policy through Progressive that covered passengers.

The plaintiff is demanding $150,000 and is represented by Leonard G. Villari and Joshua G. Villari of Villari, Lentz and Lynam of Philadelphia.
