New owners of minor league baseball team sue to release escrow money

The new owners of the Sugar Land Skeeters Baseball Team have filed suit to release stadium improvement escrow funds.

The ODP West LLC filed suit Oct. 26 in the U.S. District Court for the Eastern District of Pennsylvania against BZMZ Interests Ltd. and Robert and Marcie Zlotnik for a declaratory judgment compelling a $500,000 escrow fund.

On October 27, 2014, the plaintiffs purchased 66.67 percent of the Sugar Land Skeeters Baseball team located in Sugar Land, Texas. As part of the purchase agreement, the plaintiffs allege an escrow fund was established for lease payments and improvements to the team's stadium. The plaintiffs claim the defendants failed to provide sufficient backup material or an adequate accounting of escrow funds in the amount of $500,000.

The plaintiff is demanding release of escrow funds in the amount of $500,000, plus litigation costs and attorney fees. The plaintiff is represented by Matthew M. Hennesy of Lancaster, Pennsylvania.
