Man sues Silver Creek Services Inc., alleging labor violation for uncompensated time

A Pennsylvania man is suing his employer, claiming that he was violated by not receiving compensation for time worked.

Todd Bennett of Cochranton and Morgantown, West Virigina,  filed a class action complaint Nov. 12 in the U.S. District Court for the Western District of Pennsylvania against Silver Creek Services Inc., alleging violations of labor laws.

Bennett alleges that during his employment as a flowback operator with Silver Creek Services, from July 2014 to September, he regularly worked more than 100 hours per week. Additionally, Bennett was required to drive a pickup truck to complete various jobs, yet he did not have a commercial driver's license, nor was her contractually obligated to drive the truck. The complaint states that the defendant told Bennett he was exempt from overtime pay, which he claims is in violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act. 

Bennett is seeking monetary compensation of an unspecified amount for his legal fees, as well as back pay for all uncompensated hours worked. Bennett is represented by Joseph H. Chivers of The Employment Rights Group in Pittsburgh.
