Makers of recalled baby wipes sued after father contracts bacterial infection

PHILADELPHIA – Parents from Randall County, Texas are suing an infant care products company alleging negligence after the husband developed a deadly infection from using recalled baby wipes.

Aaron and Erin Heisler filed a complaint on Nov. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Nutek Disposables Inc., First Quality Enterprises Inc., and Wal-Mart Stores Inc., citing negligence, strict liability in tort and failure to warn, breach of warranty, deceptive trade practices, and violations of the Pennsylvania Unfair Trade Practices and Consumer Protection Law and New York law.

The plaintiffs purport that during 2014, while using Simply Right Baby Wipes for their twin daughters, Aaron suffered an infection of Burkholderia cepacia, which exacerbated his cystic fibrosis. Their allegations are corroborated by a Food and Drug Administration recall on the wipes for the bacteria that was released on Oct. 25, 2014. 

According to the complaint, exposure to the bacteria caused repeated lung infections and now Aaron Heisler is no longer eligible for a lung transplant. The plaintiffs are claiming that it was the company's responsibility to inspect the wipes and prevent such incidents from occurring.

The Heislers are seeking monetary compensation of an unspecified amount for all past and future medical expenses, all legal charges and all pains suffered. They are represented by Samuel C. Stretton in West Chester and David Mullin and Richard Biggs of Amarillo.
