Mother sues Amtrak after the death of her son in derailment accident

PHILADELPHIA – A mother is suing Amtrak alleging that the transportation company is responsible for the death of her son.

Susan Zemser, a New York resident, filed a complaint on Sept. 9 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., also known as Amtrak, purporting that the company caused the death of her son through negligence and recklessness.

Zemser claims that on May 12, while her son Justin was on Amtrak train 188 and traveling home to see his parents, the train was maintaining a velocity of approximately 106 miles per hour in a 50-mile-per-hour zone and approached a dangerous curve in the track near Philadelphia. Allegedly, due to the speed of the train, it derailed and Justin Zemser was thrown violently from his seat, sustaining serious injuries and shortly was declared dead. The plaintiff claims that the defendant was negligent through the recklessness exhibited.

Zemser is seeking compensation for all legal, emotional and punitive damages suffered. She is represented by Jordan K. Merson of Kramer, Dillof, Livingston and Moore in New York. The case is being heard by Judge Legrome D. Davis.
