PHILADELPHIA – A Wayne man is suing his former employer alleging violation of disability accommodations when he was terminated from his position.

Robert Oliver filed a complaint on Oct. 29 in the U.S. District Court for the Eastern District of Pennsylvania against his employer, Wawa Inc., alleging violation of the Americans with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, Oliver was employed by the defendant for a period of 20 years, during which time he was open about his disability and challenges with anxiety. Due to his disability, Oliver was given medical restrictions by his doctor, in which is his employer allegedly was aware but did not accommodate. The plaintiff claims he was terminated on Feb. 28, 2014, after absences related to his disability and that it was a violation of the Americans with Disabilities Act.

Oliver is seeking compensation for all damages suffered, lost benefits, wages and employment. He is represented by Edward C. Sweeney of Wusinich and Brogan P.C. in Downingtown.
