Driver sues Martin Transport claiming violation of ADA, unlawful termination

SCRANTON – A resident of York is suing his former employer over claims his disability accommodations were violated and he was illegally terminated.

Aaron Anderson filed a complaint on Sept. 1 in the U.S. District Court for the Middle District of Pennsylvania against Martin Transport LTD, alleging violations of the Americans with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff, an individual suffering with sleep apnea, was employed by Martin Transport from June until December 2013. The complaint states that during his employment had a number of requirements for his work conditions, one of which was to have the use of a continuous positive airway pressure machine, otherwise known as a CPAP. The complaint states that Martin Transport allegedly provided Anderson with a defective CPAP machine and additionally placed him in a vehicle that had been used by a smoker, which was in violation of his health requirements.

The complaint states at the defendant required Anderson to use the CPAP machine for a specified amount of time, but he claims he was unable to do so because of his truck's faulty auxiliary power unit. He claims he was terminated over allegations that he did not use his CPAP machine for the recommended amount of time. Anderson is suing the defendant for violation of the ADA and unlawful termination of employment.

Anderson is seeking compensation for all damages suffered. He is represented by Gregory E. Monskie of Benn Law Firm in York.
