Employee sues Keane Frac over allegations of unpaid overtime

Overtime

PITTSBURGH – An employee is suing a gas and oil service company after he claims he never received compensation for overtime.

Kalven Metz filed a class-action complaint on Dec. 2 in the U.S. District Court for the Western District of Pennsylvania against Keane Frac TX LLC, Keane Frac ND LLC, Keane Frac GP LLC, Keane Frac LP and Keane Group, alleging violations of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, Metz worked for the defendant and fulfilled a number of responsibilities that included working 84-hour workweeks. Although he did not receive overtime pay, the defendant allegedly guaranteed a weekly bonus of $800. Despite the salary and bonuses, Metz and his co-workers are non-exempt individuals who should have received overtime pay from the defendant, rather than weekly bonuses, the complaint states.

Metz and his co-workers are seeking compensation for all uncompensated hours and legal fees incurred. He is represented by Joshua P. Geist of Goodrich and Geist P.C. in Pittsburgh and by Michael A. Josephsn, Andrew Dunlap, Lindsay R. Itkin and Jessica M. Bresler of Fibich, Leeborn, Copeland, Briggs and Josephson of Houston.
